1. Acceptance of Terms
   By clicking “Purchase,” you agree to these Terms of Sale.
2. All Sales Final / Sold As-Is
   All items are sold “AS-IS” and “WITH ALL FAULTS.” We provide high-definition “Proof of Quality” photos of each item before it ships. Once the item is packed, Fly High and Jewelry By Ben are not liable for any damages, wear, or tear occurring thereafter.
3. Shipping & Carrier Responsibility (“Badger” Clause)
   We are a manufacturer, not a logistics company. Any damage, loss, delay, or issues occurring in transit are disputes between the Buyer and the Carrier (including shipping carrier negligence or shipping errors). We do not issue refunds for shipping errors.
4. Limitation of Liability
   To the maximum extent permitted by law, the Merchant is not liable for issues arising after the point of shipment, including (but not limited to):

• Shipping carrier negligence (damage, loss, or “wild animal” interference)
• Customer-inflicted damage (peeling, scratching, improper care)
• Allergic reactions
• “Change of mind”
  If liability is found, it is strictly limited to the purchase price of the item.

1. Mandatory Binding Arbitration / Waiver of Court
   By purchasing, you waive the right to sue in court. Any dispute must be resolved through private binding arbitration at the Buyer’s expense. You agree not to bring small-claims or class-action suits against this business. If you file a frivolous suit, you agree to pay our legal fees at a rate of $500/hour.
2. Intellectual Property / Original Designs
   Our designs are 1-of-1 creations. Any attempt to claim “copying” or “harassment” based on similar designs will be met with a counter-suit for $5,000 minimum in lost production time.
